# Terms of Service

These Terms of Service ("Terms") govern your use of Tractornuity (the "Service"), operated by Perkio Technology Group, LLC ("we", "us", "our"). By using the Service you agree to these Terms.
## 1. Account
You must be at least 13 years old to use the Service. If you create an account on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
You are responsible for maintaining the security of your account credentials. You agree to notify us promptly of any unauthorized access.
## 2. Subscription tiers
The Service offers a free tier and paid tiers. Specifications, limits, and pricing for each tier are described on our [pricing page](/pricing). We may adjust the limits of the free tier or the features included in any paid tier; we will give reasonable notice of material changes.
The free tier is supported by advertisements. By using the free tier, you acknowledge that the Service will display third-party and direct sponsor advertisements as described in our [Privacy Policy](/legal/privacy) and [Cookies Policy](/legal/cookies). Paid tiers (Plus and Fleet) are advertisement-free.
## 3. Acceptable use
You agree not to:
- Use the Service for unlawful purposes.
- Reverse engineer, decompile, or attempt to extract the source code of the Service, except to the extent permitted by applicable law.
- Probe, scan, or test the vulnerability of the Service or systems connected to it without authorization.
- Use the Service to send unsolicited communications, distribute malware, or interfere with other users.
- Misrepresent the identity of equipment, service records, or other content you upload.
## 4. Your content
You retain ownership of the data you put into the Service (machines, service records, photos, etc.). By uploading data, you grant us a limited license to store, process, and display it as necessary to operate the Service for you and any users with whom you have shared an entity.
You are responsible for ensuring you have the rights to upload any content, including photos, manuals, and reports.
## 5. Service availability
We aim to provide the Service reliably but do not guarantee uninterrupted availability. The Service is provided "as is" and "as available." We may suspend the Service for maintenance, security, or other operational reasons, with notice when feasible.
## 6. Termination
You may delete your account at any time. We may suspend or terminate your account if you materially violate these Terms or engage in fraud, abuse, or activity that endangers the Service or other users. We will give notice when feasible.
On termination, we delete or anonymize your personal information as described in the Privacy Policy.
## 7. Disclaimer
Tractornuity is a record-keeping and reminder tool. It does not replace the manufacturer's official maintenance schedule, dealer service, or qualified mechanical advice. **You are responsible for the safe operation and maintenance of your equipment.** Service intervals and bulletins shown in the Service are provided for informational purposes and may not reflect the current state of any specific machine.
To the maximum extent permitted by law, the Service is provided without warranties of any kind, including merchantability, fitness for a particular purpose, or non-infringement.
## 8. Limitation of liability
To the maximum extent permitted by law, Perkio Technology Group, LLC and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. Our total liability for any claim related to the Service is limited to the amount you paid us in the 12 months preceding the claim, or USD $50, whichever is greater.
Some jurisdictions do not allow the limitation of liability for certain damages; in those jurisdictions, our liability is limited to the maximum extent permitted.
## 9. Indemnification
You agree to indemnify and hold harmless Perkio Technology Group, LLC from claims arising out of your violation of these Terms, your content, or your unlawful use of the Service.
## 10. Governing law
These Terms are governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to conflict of laws principles. The exclusive venue for any dispute is the state or federal courts located in Montgomery County, Pennsylvania.
If you are a consumer in the European Economic Area, the United Kingdom, or another jurisdiction with mandatory consumer protections, those protections apply to you regardless of this section.
## 11. Changes to these Terms
We may update these Terms. When we make material changes, we will:
- Post the updated Terms at this URL with a new "Last updated" date.
- Bump the terms_version, which causes the Service to prompt you to review and accept the new Terms on your next visit.
Your continued use after the new Terms take effect constitutes acceptance.
